概要 | This paper examines the possibility and implication of Section 58 of the Australian Constitution which provides the Governor-General discretionary power when legislation passed by the both Houses of Parliament is presented for royal assent. While it has been seen as a mere formality, advent of the minority government in 2010 shed new lights on section 58. Under the minority government, it is possible for the Opposition and cross bench members to have their bill pass through the both houses of parliament and present to the Governor-General for royal assent. There is a potential conflict between the principles of responsible government and representative government. This paper use primary and secondary sources as well as interviews with key players such as constitutional experts and Clerks of the House of Representatives and the Senate. |
